Nghiệp vụ tra mã HS là một trong những công việc mà nhân viên xuất nhập khẩu nào cũng phải biết. Tuy nhiên không phải ai cũng nắm được các cách tra mã HS để tiết kiệm thời gian mà vẫn đảm bảo tính hợp lý của mã HS với hàng hóa. Đầu tiên, để nắm được kiến thức tổng quát về mã HS và cách tra mã HS, các em phải nắm được 6 quy tắc phân loại hàng hóa kinh điển dưới đây. 
Nhằm thống nhất cách phân loại hàng hóa cho tất cả các quốc gia, Công ước HS quy định việc áp mã HS phải tuân theo tuần tự 6 quy tắc này. 
Tùy trường hợp cụ thể, để phân loại hàng hóa sát với danh mục HS nhất, ta phải dựa vào một hay một số căn cứ sau đây:
  • Danh mục hàng hóa xuất khẩu, nhập khẩu Việt Nam (danh mục HS); Biểu thuế xuất khẩu; Biểu thuế Nhập khẩu
  • Các chi tiết, thông số kỹ thuật được mô tả dựa trên thực tế hàng hóa
  • Tài liệu kỹ thuật, hình ảnh minh họa, catalogue, tem, nhãn mác
  • Kết quả phân tích phân loại, kết quả giám định hàng hóa
QUY TẮC 1Từ khóa trong mô tả tên hàng + Chú giải
Dựa vào tên đích danh của mặt hàng, chúng ta có thể định hình được mặt hàng của mình thuộc Phần, Chương nào dựa vào tên Phần, Chương Chú giải Phần, Chú giải Chương;
Dựa vào cách diễn giải ở các chú giải, ta có được các chỉ dẫn để tìm đến Chương, Nhóm chứa mặt hàng ta đang tìm kiếm. Các chú giải Chương và Phân chương (nếu có) có tính chất quyết định đến việc phân loại hàng hóa, áp dụng cho cả 6 quy tắc.
Ví dụ: Xác định mã HS của băng truyền bằng cao su lưu hóa dùng cho máy vận chuyển hàng hóa tự động. Cách tra mã HS của hàng hóa này như sau:
 Đối với sản phẩm này, ta có một số từ khóa định hướng như “băng truyền”, “sản phẩm bằng cao su lưu hóa” (Chương 40), hoặc dự đoán nó sẽ nằm trong nhóm bộ phận của máy/thiết bị cơ khí (Phần XVI). Tuy nhiên, ta phải đọc chú giải của các Phần, Chương liên quan để xác định chính xác nhất mặt hàng này.
  • Xác định được băng tải bằng cao su thuộc nhóm 4010 (Chương 40)
  • Trong nhóm 4010 được chi tiết nhỏ hơn theo chất liệu gia cố, kích thước, thiết kế… Vậy, chúng ta cần yêu cầu bên bán cung cấp thêm chi tiết mặt hàng (catalogue, tài liệu kỹ thuật…) sao cho sát với mô tả trong biểu thuế nhất để dẫn chúng ta đến mã HS 8 chữ số cuối cùng.
Rất nhiều hàng hóa được phân loại theo tên đích danh trong danh mục HS. Nên trong quá trình dịch nghĩa từ tên hàng tiếng Anh (hay ngoại ngữ khác) sang Tiếng Việt, ta nên lựa chọn ngôn ngữ sao cho gần giống nhất với mô tả và các từ ngữ thể hiện trong Danh mục HS nhất để tiện lợi trong khâu kiểm tra hồ sơ giấy và kiểm tra thực tế hàng hóa.

Khi các em là nhân viên mới, chưa có kinh nghiệm nhiều về mặt hàng, chắc chắn các em sẽ lúng túng khi nhận được một bộ chứng từ có tên hàng thể hiện bằng tiếng Anh. Và 99% tên hàng Tiếng Anh thể hiện trên chứng từ đó đều chỉ là từ khóa của mặt hàng. Chỉ căn cứ vào một số từ khóa hiếm hoi đó mà các em sẽ phải dịch và diễn giải, mô tả thành một tên hàng đầy đủ các thông tin để bất kỳ ai đọc đều có thể hiểu được (đặc biệt là các bác Hải quan). 

QUY TẮC 2: Cách tra mã HS đối với các sản phẩm có nhiều thành phần chất liệu hoặc có cấu tạo đặc biệt
Quy tắc 2a) Sản phẩm chưa hoàn chỉnh hoặc chưa hoàn thiện, chưa lắp ráp hoặc tháo rời. 
Một mặt hàng chưa hoàn chỉnh hoặc chưa hoàn thiện, có thể thiếu một số bộ phận phụ hoặc phụ kiện nhưng cơ bản đã mang đặc trưng của sản phẩm hoàn chỉnh thì được phân loại như sản phẩm đã hoàn thiện.
VD: Chiếc xe đạp thiếu yên xe và tay lái vẫn được phân loại như xe đạp hoàn thiện.

Đối với một số mặt hàng cồng kềnh, hàng nặng, thường phải tháo rời nhằm mục đích thuận tiện trong khâu vận chuyển, người ta có thể tháo rời và đóng gói riêng lẻ. Tuy nhiên, các bộ phận linh kiện này phải được liệt kê đầy đủ trong phiếu đóng gói và khớp số lượng, kích thước, mẫu mã với bản vẽ hoặc tài liệu kỹ thuật đi kèm.
Các “hàng hóa ở dạng chưa lắp ráp hoặc tháo rời” được hiểu là các bộ phận, linh kiện cấu thành hàng hóa phù hợp để lắp ráp được với nhau bằng những dụng cụ, thiết bị đơn giản (vít, bu-lông, ê -cu,v.v…), bằng đinh tán hoặc hàn, với điều kiện những hoạt động này chỉ đơn thuần là lắp ráp, không được trải qua bất cứ quá trình gia công thêm nào và không quan trọng quá trình lắp ráp phức tạp hay không.
Trường hợp số linh kiện nhập về nhiều hơn số lượng cần thiết, các linh kiện dư thừa phải được phân loại và khai báo theo mã riêng của bộ phận hoặc linh kiện.
VD: Phân loại hàng hóa cho sản phẩm là: Linh kiện máy đồng hồ cá nhân hoàn chỉnh chưa lắp ráp

Một số sản phẩm do tính đặc thù, trong Danh mục HS có phân chia theo sản phẩm chưa lắp ráp hoàn chỉnh thì ta có thể dễ dàng áp mã HS ngay, còn đối với các hàng hóa khác, ta vẫn áp dụng quy tắc 2a) như bình thường.

Trường hợp đặc biệt của Quy tắc 2a): được áp dụng cho hàng hóa dưới dạng phôi đã có hình phác của sản phẩm chính. Điều kiện để hàng hóa đáp ứng yêu cầu của “Phôi đã có hình phác của sản phẩm chính” bao gồm:
  • Có hình dạng hoặc đường nét bên ngoài tương đối giống với sản phẩm hoàn chỉnh
  • Chưa sẵn sàng để sử dụng trực tiếp
  • Chỉ dùng để sản xuất ra hàng hóa đó
Được phân loại như sản phẩm hoàn thiện
VD: Phôi chai nhựa được phân loại theo chai nhựa hoàn thiện

Quy tắc 2b): Hàng hóa là hợp chất của nhiều chất, hoặc hỗn hợp của nhiều nguyên liệu, chất liệu.
TH1: Các đơn chất của hợp chất hoặc các nguyên liệu, chất liệu tạo thành sản phẩm cuối cùng nếu thuộc cùng một nhóm thì hợp chất hoặc sản phẩm cũng thuộc nhóm đó.
Giả sử: Hỗn hợp gồm 2 thành phần đều thuộc nhóm 2907 thì hỗn hợp đó được phân loại vào nhóm 2907. 
TH2: Các đơn chất của hợp chất hoặc các nguyên liệu, chất liệu tạo thành sản phẩm cuối cùng nếu thuộc các nhóm khác nhau thì phân loại theo chất cơ bản nhất mang lại tính chất đặc trưng hơn của sản phẩm.
VD1: Dung dịch H2SO4 chứa 5% H2SO4 nguyên chất và 95% H2O => áp mã theo H2SO4
VD2: Dao bằng inox cán gỗ dùng trong nhà bếp  dao bằng inox mang lại tính chất đặc trưng cho sản phẩm phân loại theo dao chất liệu bằng kim loại (Nhóm 8211)

Sơ đồ tổng quan quy trình khai báo và khai sửa đổi bổ sung trong thông quan đối với hàng hóa nhập khẩu:





            1.1 Khai thông tin nhập khẩu (IDA)

– Người khai hải quan khai các thông tin nhập khẩu bằng nghiệp vụ IDA trước khi đăng ký tờ khai nhập khẩu. Khi đã khai đầy đủ các chỉ tiêu trên màn hình IDA (133 chỉ tiêu), người khai hải quan gửi đến hệ thống VNACCS, hệ thống sẽ tự động cấp số, tự động xuất ra các chỉ tiêu liên quan đến thuế suất, tên tương ứng với các mã nhập vào (ví dụ: tên nước nhập khẩu tương ứng với mã nước, tên đơn vị nhập khẩu tương ứng với mã số doanh nghiệp…), tự động tính toán các chỉ tiêu liên quan đến trị giá, thuế… và phản hồi lại cho người khai hải quan tại màn hình đăng ký tờ khai – IDC.

– Khi hệ thống cấp số thì bản khai thông tin nhập khẩu IDA được lưu trên hệ thống VNACCS.

            1.2. Đăng ký tờ khai nhập khẩu (IDC)

– Khi nhận được màn hình đăng ký tờ khai (IDC) do hệ thống phản hồi, người khai hải quan kiểm tra các thông tin đã khai báo, các thông tin do hệ thống tự động xuất ra, tính toán. Nếu khẳng định các thông tin là chính xác thì gửi đến hệ thống để đăng ký tờ khai.

– Trường hợp sau khi kiểm tra, người khai hải quan phát hiện có những thông tin khai báo không chính xác, cần sửa đổi thì phải sử dụng nghiệp vụ IDB gọi lại màn hình khai thông tin nhập khẩu (IDA) để sửa các thông tin cần thiết và thực hiện các công việc như đã hướng dẫn ở trên.

            1.3. Kiểm tra điều kiện đăng ký tờ khai

Trước khi cho phép đăng ký tờ khai, hệ thống sẽ tự động kiểm tra Danh sách doanh nghiệp không đủ điều kiện đăng ký tờ khai (doanh nghiệp có nợ quá hạn quá 90 ngày, doanh nghiệp tạm dừng hoạt động, giải thể, phá sản…). Nếu doanh nghiệp thuộc danh sách nêu trên thì không được đăng ký tờ khai và hệ thống sẽ phản hồi lại cho người khai hải quan biết.

1.4. Phân luồng, kiểm tra, thông quan: Khi tờ khai đã được đăng ký, hệ thống tự động phân luồng, gồm 3 luồng xanh, vàng, đỏ

            1.4.1 Đối với các tờ khai luồng xanh

– Trường hợp số thuế phải nộp bằng 0: Hệ thống tự động cấp phép thông quan (trong thời gian dự kiến 03 giây) và xuất ra cho người khai “Quyết định thông quan hàng hóa nhập khẩu”.

– Trường hợp số thuế phải nộp khác 0

+ Trường hợp đã khai báo nộp thuế bằng hạn mức hoặc thực hiện bảo lãnh (chung, riêng): Hệ thống tự động kiểm tra các chỉ tiêu khai báo liên quan đến hạn mức, bảo lãnh, nếu số tiền hạn mức hoặc bảo lãnh lớn hơn hoặc bằng số thuế phải nộp, hệ thống sẽ xuất ra cho người khai “chứng từ ghi số thuế phải thu” và “Quyết định thông quan hàng hóa nhập khẩu”. Nếu số tiền hạn mức hoặc bảo lãnh nhỏ hơn số thuế phải nộp, hệ thống sẽ báo lỗi.

+ Trường hợp khai báo nộp thuế ngay (chuyển khoản, nộp tiền mặt tại cơ quan hải quan….): Hệ thống xuất ra cho người khai “Chứng từ ghi số thuế phải thu”. Khi người khai hải quan đã thực hiện nộp thuế, phí, lệ phí và hệ thống VNACCS đã nhận thông tin về việc nộp thuế, phí, lệ phí thì hệ thống xuất ra “Quyết định thông quan hàng hóa”.

– Cuối ngày hệ thống VNACCS tập hợp toàn bộ tờ khai luồng xanh  đã được thông quan chuyển sang hệ thống VCIS.

            1.4.2  Đối với các tờ khai luồng vàng, đỏ

            a. Người khai hải quan

– Nhận phản hồi của hệ thống về kết quả phân luồng, địa điểm, hình thức, mức độ kiểm tra thực tế hàng hoá;

–  Nộp hồ sơ giấy để cơ quan hải quan kiểm tra chi tiết hồ sơ; chuẩn bị các điều kiện để kiểm  thực tế hàng hoá;

– Thực hiện đầy đủ các nghĩa vụ về thuế, phí, lệ phí (nếu có).

            b. Hệ thống

(1) Xuất ra cho người khai “Tờ khai hải quan” (có nêu rõ kết quả phân luồng tại chỉ tiêu: Mã phân loại kiểm tra)

(2) Xuất ra Thông báo yêu cầu kiểm tra thực tế hàng hóa đối với hàng hóa được phân vào luồng đỏ hoặc khi cơ quan hải quan sử dụng nghiệp vụ CKO để chuyển luồng.

(3) Ngay sau khi cơ quan hải quan thực hiện xong nghiệp vụ CEA hệ thống tự động thực hiện các công việc sau:

– Trường hợp số thuế phải nộp bằng 0: Hệ thống tự động cấp phép thông quan và xuất ra cho người khai “Quyết định thông quan hàng hóa”.

– Trường hợp số thuế phải nộp khác 0:

· Trường hợp đã khai báo nộp thuế bằng hạn mức hoặc thực hiện bảo lãnh (chung, riêng): Hệ thống tự động kiểm tra các chỉ tiêu khai báo liên quan đến hạn mức, bảo lãnh, nếu số tiền hạn mức hoặc bảo lãnh lớn hơn hoặc bằng số thuế phải nộp, hệ thống sẽ xuất ra cho người khai “chứng từ ghi số thuế phải thu” và “Quyết định thông quan hàng hóa”. Nếu số tiền hạn mức hoặc bảo lãnh nhỏ hơn số thuế phải nộp, hệ thống sẽ báo lỗi.

· Trường hợp khai báo nộp thuế ngay (chuyển khoản, nộp tiền mặt tại cơ quan hải quan….): Hệ thống xuất ra cho người khai “chứng từ ghi số thuế phải thu. Khi người khai hải quan đã thực hiện nộp thuế, phí, lệ phí và hệ thống VNACCS đã nhận thông tin về việc nộp thuế phí, lệ phí thì hệ thống xuất ra “Quyết định thông quan hàng hóa”.

            1.5. Khai sửa đổi, bổ sung trong thông quan

(1) Hệ thống cho phép khai sửa đổi, bổ sung trong thông quan từ sau khi đăng ký tờ khai đến trước khi thông quan hàng hoá. Để thực hiện khai bổ sung trong thông quan, người khai hải quan sử dụng nghiệp vụ IDD gọi ra màn hình khai thông tin sửa đổi bổ sung được hiển thị toàn bộ thông tin tờ khai nhập khẩu (IDA) trong trường hợp khai sửa đổi, bổ sung lần đầu, hoặc hiển thị thông tin khai nhập khẩu sửa đổi cập nhật nhất (IDA01) trong trường hợp khai sửa đổi, bổ sung từ lần thứ 2 trở đi.

(2) Khi đã khai báo xong tại nghiệp vụ IDA01, người khai hải quan gửi đến hệ thống VNACCS, hệ thống sẽ cấp số cho tờ khai sửa đổi và phản hồi lại các thông tin tờ khai sửa đổi tại màn hình IDE, khi người khai hải quan ấn nút “gửi” tại màn hình này thì hoàn tất việc đăng ký tờ khai sửa đổi, bổ sung.

(3) Số tờ khai sửa đổi là kí tự cuối cùng của ô số tờ khai, số lần khai báo sửa đổi, bổ sung trong thông quan tối đa là 9 lần tương ứng với ký tự cuối cùng của số tờ khai từ 1 đến 9; trường hợp không khai bổ sung trong thông quan thì ký tự cuối cùng của số tờ khai là 0.

(4) Khi người khai hải quan khai sửa đổi, bổ sung tờ khai, thì tờ khai sửa đổi, bổ sung chỉ có thể được phân luồng vàng hoặc luồng đỏ (không phân luồng xanh).

(5) Các chỉ tiêu trên màn hình khai sửa đổi, bổ sung (IDA01) giống các chỉ tiêu trên màn hình khai thông tin nhập khẩu (IDA). Khác nhau là một số chỉ tiêu (sẽ nêu cụ thể tại phần hướng dẫn nghiệp vụ IDA01) không nhập được tại IDA01 do không được sửa đổi hoặc không thuộc đối tượng sửa đổi.

            1.6. Những điểm cần lưu ý

            (1) Mỗi tờ khai được khai tối đa 50 mặt hàng, trường hợp một lô hàng có trên 50 mặt hàng, người khai hải quan sẽ phải thực hiện khai báo trên nhiều tờ khai, các tờ khai của cùng một lô hàng được liên kết với nhau dựa trên số nhánh của tờ khai

            (2) Trị giá tính thuế

– Khai báo trị giá: Ghép các chỉ tiêu của tờ khai trị giá theo phương pháp 1 vào tờ khai nhập khẩu; Đối các phương pháp khác, chỉ ghép một số chỉ tiêu kết quả vào tờ khai nhập khẩu, việc tính toán cụ thể trị giá theo từng phương pháp phải thực hiện trên tờ khai trị giá riêng.

– Tự động tính toán: Đối với các lô hàng đủ điều kiện áp dụng phương pháp trị giá giao dịch, người khai hải quan khai báo Tổng trị giá hoá đơn, tổng hệ số phân bổ trị giá, trị giá hoá đơn của từng dòng hàng, các khoản điều chỉnh, hệ số phân bổ các khoản điều chỉnh, trên cơ sở đó, hệ thống sẽ tự động  phân bổ các khoản điều chỉnh và tự động tính trị giá tính thuế cho từng dòng hàng.

– Không tự động tính toán: Đối với các lô hàng đủ điều kiện áp dụng phương pháp trị giá giao dịch nhưng ngoài I và F còn có trên 5 khoản điều chỉnh khác hoặc việc phân bổ các khoản điều chỉnh không theo tỷ lệ trị giá thì hệ thống không tự động phân bổ, tính toán trị giá tính thuế; Đối với các trường hợp này, người khai hải quan khai báo, tính toán trị giá tính thuế của từng dòng hàng tại tờ khai trị giá riêng, sau đó điền kết quả vào ô “trị giá tính thuế” của từng dòng hàng.

            (3) Tỷ giá tính thuế

Khi người khai hải quan thực hiện nghiệp vụ khai thông tin nhập khẩu IDA, hệ thống sẽ áp dụng tỷ giá tại ngày thực hiện nghiệp vụ này để tự động tính thuế:

– Trường hợp người khai hải quan thực hiện nghiệp vụ khai thông tin nhập khẩu IDA và đăng ký tờ khai IDC trong cùng một ngày hoặc trong 02 ngày có tỷ giá giống nhau thì hệ thống tự động giữ nguyên tỷ giá tính thuế;

– Trường hợp người khai hải quan thực hiện nghiệp vụ đăng ký tờ khai  IDC (được tính là thời điểm người khai hải quan ấn nút “Gửi” tại màn hình IDC) tại ngày có tỷ giá khác với tỷ giá tại ngày khai thông tin nhập khẩu IDA thì hệ thống sẽ báo lỗi. Khi đó, người khai hải quan dùng nghiệp vụ IDB gọi bản IDA để khai báo lại – thực chất là chỉ cần gọi IDA và gửi luôn hệ thống sẽ tự động cập nhật lại tỷ giá theo ngày đăng ký tờ khai.

            (4) Thuế suất

– Khi người khai hải quan thực hiện nghiệp vụ khai thông tin nhập khẩu IDA, hệ thống sẽ lấy thuế suất tại ngày dự kiến khai báo IDC để tự động điền vào ô thuế suất.

– Trường hợp thuế suất tại ngày IDC dự kiến khác thuế suất tại ngày IDC, thì khi người khai hải quan thực hiện nghiệp vụ đăng ký tờ khai IDC hệ thống sẽ báo lỗi, khi đó, người khai hải quan dùng nghiệp vụ IDB gọi bản IDA để khai báo lại – thực chất là chỉ cần gọi IDA và gửi luôn, hệ thống tự động cập nhật lại thuế suất theo ngày đăng ký tờ khai IDC.

– Trường hợp người khai hải quan nhập mức thuế suất thủ công thì hệ thống xuất ra chữ “M” bên cạnh ô thuế suất.

(5) Trường hợp hàng hóa thuộc đối tượng miễn/giảm/không chịu thuế

– Việc xác định hàng hóa thuộc đối tượng được miễn thuế XK không căn cứ vào Bảng mã miễn/giảm/không chịu thuế, mà phải thực hiện theo các văn bản quy định, hướng dẫn liên quan.

– Chỉ sau khi đã xác định được hàng hóa thuộc đối tượng được miễn thuế XK mới áp mã dùng trong VNACCS theo Bảng mã miễn/giảm/không chịu thuế.

– Nhập mã miễn/giảm/không chịu thuế vào chỉ tiêu tương ứng trên màn hình đăng ký khai báo nhập khẩu (IDA).

– Trường hợp hàng hóa thuộc đối tượng miễn thuế nhập khẩu thuộc diện phải đăng ký DMMT trên VNACCS (TEA) thì phải nhập đủ cả mã miễn thuế và số DMMT, số thứ tự dòng hàng trong DMMT đã đăng ký trên VNACCS.

– Trường hợp hàng hóa thuộc đối tượng miễn thuế Nhập khẩu thuộc diện phải đăng ký DMMT nhưng đăng ký thủ công ngoài VNACCS thì phải nhập mã miễn thuế và ghi số DMMT vào phần ghi chú.

(6) Trường hợp hàng hóa chịu thuế giá trị gia tăng

– Việc xác định hàng hóa, thuế suất giá trị gia tăng không căn cứ vào Bảng mã thuế suất thuế giá trị gia tăng; mà phải thực hiện theo các văn bản quy định, hướng dẫn liên quan.- Chỉ sau khi đã xác định được hàng hóa, thuế suất cụ thể theo các văn bản quy định, hướng dẫn liên quan mới áp mã dùng trong VNACCS theo Bảng mã thuế suất thuế giá trị gia tăng.

– Nhập mã thuế suất thuế giá trị gia tăng vào chỉ tiêu tương ứng trên màn hình đăng ký khai báo nhập khẩu (IDA).

(7) Trường hợp doanh nghiệp không đủ điều kiện đăng ký tờ khai (do có nợ quá hạn quá 90 ngày hoặc Doanh nghiệp giải thể, phá sản, tạm ngừng kinh doanh,…)

Hệ thống tự động từ chối cấp số tờ khai và báo lỗi cho phía người khai lý do từ chối tiếp nhận khai báo. Tuy nhiên, nếu hàng nhập khẩu phục vụ trực tiếp an ninh, quốc phòng, phòng chống thiên tai, dịch bệnh, cứu trợ khẩn cấp, hàng viện trợ nhân đạo, viện trợ không hoàn lại thì hệ thống vẫn chấp nhận đăng ký tờ khai dù doanh nghiệp thuộc danh sách nêu trên.

(8) Trường hợp đăng ký bảo lãnh riêng trước khi cấp số tờ khai (bảo lãnh theo số vận đơn/hóa đơn)

Số vận đơn hoặc số hóa đơn đã đăng ký trong chứng từ bảo lãnh phải khớp với số vận đơn/số hóa đơn người khai khai báo trên màn hình nhập liệu.

Hệ thống sẽ tự động xuất ra các chứng từ ghi số thuế phải thu tương ứng với từng thời hạn nộp thuế. Trường hợp người khai làm thủ tục nhập khẩu nhiều mặt hàng nhưng các mặt hàng có thời hạn nộp thuế khác nhau, người khai sẽ phải khai trên các tờ khai khác nhau tương ứng với từng thời hạn nộp thuế.

2. Cách thức thực hiện:

Việc khai, tiếp nhận, xử lý thông tin khai hải quan, trao đổi các thông tin khác theo quy định của pháp luật về thủ tục hải quan giữa các bên có liên quan thực hiện thông qua Hệ thống xử lý dữ liệu điện tử hải quan;

            3. Thành phần, số lượng hồ sơ:

– Thành phần hồ sơ:

+ Tờ khai hàng hoá nhập khẩu.

+ Các chứng từ đi kèm tờ khai (dạng điện tử hoặc văn bản giấy): theo quy định tại Điều 24 Luật Hải quan.

– Số lượng hồ sơ: 01 bản giấy hoặc điện tử.

            4. Thời hạn giải quyết:

– Hệ thống phản hồi cho người khai hải quan ngay sau khi hệ thống tiếp nhận, công chức hải quan chấp nhận kết quả phân luồng/từ chối tờ khai trừ các trường hợp bất khả như nghẽn mạng, hệ thống đường truyền gặp sự cố…

– Thời hạn hoàn thành thành kiểm tra thực tế hàng hóa, phương tiện vận tải (tính từ thời điểm người khai hải quan đã thực hiện đầy đủ các yêu cầu về làm thủ tục hải quan theo quy định tại điểm a và điểm b khoản 2 Điều 23 Luật Hải quan):

+ Chậm nhất là 08 giờ làm việc đối với lô hàng xuất khẩu áp dụng hình thức kiểm tra thực tế một phần hàng hóa theo xác suất;

+ Chậm nhất là 02 ngày làm việc đối với lô hàng xuất khẩu áp dụng hình thực kiểm tra thực tế toàn bộ hàng hóa.

Trong trường hợp áp dụng hình thức kiểm tra thực tế toàn bộ hàng hóa mà lô hàng xuất khẩu có số lượng lớn, việc kiểm tra phức tạp thì thời hạn kiểm tra có thể được gia hạn nhưng không quá 08 giờ làm việc.

            5. Đối tượng thực hiện thủ tục hành chính: Tổ chức, cá nhân

Trước khi thực hiện thủ tục hải quan, người khai hải quan phải:

– Có chữ ký số được đăng ký;

– Đăng ký người sử dụng Hệ thống VNACCS/VCIS;

– Làm thủ tục cấp mã địa điểm kiểm tra hàng hóa xuất khẩu, nhập khẩu. Trường hợp doanh nghiệp không được công nhận địa điểm kiểm tra tại chân công trình, cơ sở sản xuất, nhà máy, doanh nghiệp phải đưa hàng hoá đến địa điểm kiểm tra tập trung để kiểm tra (áp dụng đối với các lô hàng được hệ thống VNACCS phân vào luồng đỏ).

            11. Căn cứ pháp lý của thủ tục hành chính:

– Luật Hải quan số 54/2014/QH13 ngày 23/06/2014;

– Nghị định số 08/2015/NĐ-CP ngày 21/01/2015 của Chính phủ quy định chi tiết và biện pháp thi hành Luật Hải quan về thủ tục hải quan, kiểm tra, giám sát, kiểm soát Hải quan;

Infestations of Brown Marmorated Stink Bug found on ships en-route to Australia are causing havoc with local supply chains. Bugs are breeding, ships are re-routing, trucks are idling, supply chains are collapsing, costs are escalating... and tempers are fraying.

At least three vessels have been ordered by local biosecurity authorities to leave Australian waters and seek insect eradication treatment elsewhere. The latest vessel to be ordered away from Australia was the Thalatta (IMO 9702455), a Wallenius Wilhelmsen car carrier that was ordered away from Fremantle, Western Australia, while carrying a cargo of vehicles and machinery. The other two vessels ordered to leave were also car carrier vessels; one was ordered out in December and the other was asked to leave in November.

It's not just car carrier vessels that are at risk though. So are box ships, break bulk ships and other general cargo ships. It is difficult to overstate the maritime and on-land consequences for a vessel to be ordered away from Australia to seek insect eradication treatment elsewhere.

On the marine-side, FreightWaves understands from local contacts that at least one vessel has incurred over A$250,000 (US$180,000) in direct costs after being ordered to leave Australia. Ports/terminals, marine pilots and other such service providers will charge a "no-show" fee to a vessel that doesn't turn up. Then there's all the wasted expenditure if the vessel actually makes it to Australia only to be turned away – there are expenditures for fuel, provisions, fumigation or heat treatment, crew time, the opportunity costs of not being available for hire and so on. These latter costs are then re-incurred if the ship is sent somewhere else, such as Singapore, for fumigation.

If box ships (as opposed to other types of ships) are ordered away from Australia, there are a variety of other box-specific costs. There are direct costs payable to stevedores in container storage fees, possibly demurrage costs for late discharge of ships (in which a ship has docked but is delayed) and container detention fees payable to the shipping lines for late return of empty boxes.

But that's not all. There are other cost-incurring adverse effects that ripple through the system.

I've got a lovely bunch of… cargo ships

No matter where the insects are detected, they're bad news for pan-Australian logistics. Peter Anderson of the Victorian Transport Association (a trucking company representative body for the state of Victoria) told FreightWaves that infested ships are typically detected in or near either Fremantle or Brisbane. Maritime carriers typically make Singapore their last port of call to pick up trans-shipped cargo of various kinds before heading south to sail the loop around Australia. Ships typically sail in a clockwise direction around Australia from east-to-west on a Singapore-Brisbane-Sydney-Melbourne-Adelaide-Fremantle-Singapore rotation. A smaller number sail in the counter-clockwise direction. These patterns of port calls explain why either Fremantle or Brisbane is often the first port of detection.

"So a ship hits in Fremantle or Brisbane, then it wouldn't have gotten to us [in Melbourne or Sydney] for a week, so it gives us a week to organise ourselves," says Anderson, explaining that ship turn-arounds cause few immediate logistics problems in the two biggest Australian cities.

Those problems arrive shortly after the ship turn-around.

"It throws the schedules out. You have ship bunching – it's not just the cargo that's delayed. You then get something like three ships trying to get into Brisbane at once. Bunching causes problems for transport operators," he said, adding that the turn-back of the Wallenius car-carrier in Western Australia caused bunching in Melbourne a week later.

"We had nine ships bunched in Melbourne because of what happened in Western Australia. Ship bunching causes lots of pressure and activities with no improvement on return," Anderson said.

But the problems, of course, don't end there.

Cascading problems

It's entirely possible that the authorities won't allow the goods or a ship to enter Australia at all. If the ship doesn't turn up when expected, then, on the landside logistics front, there's a cascading effect of disappointments and incurred costs. Importers may miss deadlines on supply contracts. Forwarders and brokers have to tell their customers that their goods are not, or not yet, on the way. There's a loss to trucking businesses for the lost drayage jobs. If the trucks are idled then the drivers are left twiddling their thumbs.

"Drivers still have to be paid. You can't just send them home. It's neither fair to the driver nor the business," comments Simon O'Hara of Road Freight NSW, a local transport body. "Everyone's ready to pick stuff up. They've got their own logistics in place. Systems are in sync with the local port. It's a major pain in the neck," he comments.

Many of these problems can potentially cascade further along in the supply chain in part or full at inland intermodal terminals, distribution centres and customer premises. And then someone has to re-organise, and pay for, the set up of a replacement supply chain ready to move the goods when they actually do land in Australia.

It's a (stink) bug's life

There's a lot of hate for Halyomorpha Halys. And It's not just because the malodorous bug is whiffy (it smells like a particularly rancid version of cilantro/coriander, apparently).

It's fertile.

And, worse, it's hungry.

The stink bug is a mass breeder that feeds on hundreds of different plant species – fruit, trees, vegetables, ornamentals – and it does so by sticking its proboscis inside the plant. That weakens the plant, makes its fruit both visually unappealing and inedible while also making the plant susceptible to infection by pathogens. Crops infested by the stink bug are simply ruined.

And that's a big deal for Australia. The gross value of Australian farm production in 2016-17 was A$60 billion, about three percent of Australia's total gross domestic product (GDP). About 77 percent of that is exported, earning about A$44.8 billion in the 2016-17 financial year, according to the National Farmers' Federation.

Colonial expansion

Unfortunately, the bug is swarming to, and colonising, new areas.

"Forget about high-risk countries being targeted for treatment; the indication from [the Australian] government is that, by next season, we will be talking about treatment of goods from high-risk continents," comments the Freight & Trade Alliance, a locally-based association for the international supply chain sector.

The stink bug is a mobile little hitch-hiker. Originating in northern Asia, the bug is now widely established in Europe and North America. The bug's range is expanding because it's a 2km (1.24 miles) a day flyer that likes to hide en-mass in crevices, cracks and crannies. So it can easily infest cargo-carrying vehicles like trucks, planes and ships. That explains why ro-ro/car-carrying vessels appear to have particularly been affected in the current season: cars, trucks and farm equipment are just full of the little-hidey spaces that the stink bug favours.

Vessels and cargoes from high-risk countries destined for Australia must be fumigated or heat-treated offshore to meet local biosecurity rules. But there there is some concern in the local industry about pre-loading infestation treatments. It appears that Wallenius Wilhelmsen had its vessel and cargo pre-treated, and certified as such, prior to departure. But still the bugs came along anyway. It's not the first time that insects have been found after an eradication treatment has been carried out. It is not known if the presence of insects is due to the pests simply being able to somehow survive, new bugs arriving to make a new home post-treatment, or merely a sloppy job carried out by the exterminators. It may be interesting to note that the local biosecurity authorities stopped accepting certificates for sulfuryl fluoride treatments done in Italy.

"This was in response to [Brown Marmorated Stink Bug] detections and a review of treatment providers and certificates," reads a statement from the Australian Department of Agriculture & Water Resources.

Managing not to manage

There is a lot of local industry criticism levelled at the Australian biosecurity authorities. "We are seeing that the Government's response to [the stink bug] is causing great uncertainty for importers and their customers… we are concerned that greater predictability will not come any time soon," says trade and customs lawyer Russell Wiese of Hunt & Hunt lawyers.

The Freight & Trade Alliance has accumulated a litany of complaints about the bureaucratic response to the stink bug threat. These include allegations of ineffective planning; a lack of trained biosecurity officers; a lack of weekend working and overtime for those officers; information technology failures; too broad profiling in too many areas; delays in processing and inspections; limited treatment options; removal of various insect exterminators from the approved list (including the whole country of Italy); a lack of training for industry; a lack of onshore treatment options; inflexibility in dealing with one-off scenarios; and, finally, a lack of information and quantifiable intelligence.

That's quite a list of criticisms. FreightWaves sought a response from the Australian federal Department of Agriculture and Water Resources. The Department did reply but mostly did not address the charges levelled against it by industry.

A response, edited by FreightWaves for brevity and relevance, reads: "The Department's priority is biosecurity and ensuring we have strict measures in place to safeguard our environment, industries and animal and human health from pests and diseases. We have implemented stronger measures than ever before this season to manage risks associated with this significant pest. The Department is aware of some delays in clearance of imported cargo, and ports in Sydney and Melbourne will be those most affected. These delays have been due to several factors including seasonal trade peaks, system outages and [stink bug] requirements. Importers have been provided with advice by the Department on how they can assist to minimise delays including by having goods treated offshore and early lodgement of required documentation. The Department has deployed all available resources to manage the delays, including engaging additional staff and use of overtime."

Desperate and expensive work-arounds work… for now

Meanwhile, freight forwarders are trying to work around the problems by resorting to "desperate and expensive measures using a combination of sea cargo movements from origin, trans-shipping cargo at intermediary ports [then] using air freight to land goods into Australia," according to the Freight & Trade Alliance.

However, the industry anticipates that this particular loophole will be closed by the authorities and that air cargo shipments will face biosecurity controls before too long. As Wiese comments, "the impact of the stink bug… will motivate our Government to adopt a zero tolerance approach. In the delicate balance between biosecurity and trade facilitation, biosecurity will always win."

How to import goods from France to Australia
1. Product sourcing & validation
Italy has some of the best apparel manufacturers in the world if you’re lucky enough to connect with one of them. Italian artisans have been taught how to make apparel and apparel accessories over decades by their grandparents and parents.

A majority of Italian manufacturers (92%) are SMEs. This makes it easier to negotiate, source, and develop products for startups due to the lower minimum order requirement. Italian goods are highly valued in Australia as being quality-backed by its craftsmen, and are often tagged with a higher price when 'Made in Italy'.

Connecting with a high quality Italian manufacturer can be difficult, especially if you don’t speak Italian and are new to the world of manufacturing.

Australian requirements for importers: Australia has very strict biosecurity laws surrounding certain products. You must keep track of the product safety standards, labelling requirements, and laws surrounding import permits.
Sourcing suppliers: As Italian suppliers are mostly SMEs, and there are no 'directory' like Alibaba for China, it is best to actually visit Italy to source your supplier. Otherwise, beware that there is a language barrier when searching for suppliers online, as most Italian suppliers may not speak English.
Products sourced from Italy are generally higher priced. Use this calculator to see if the manufacturing costs are within your budget.
Product validation is always a necessary step before importing any goods into Australia. If you are a new business, make sure your product or business idea is well and truly marketable and sellable in Australia. Do not over-commit to a big order before doing this step.

2. Discuss terms of trading with your supplier
Your terms of trading could determine how much responsibility you may have with your cargo. Read about our Incoterms and why this is so important to establish from the get-go with your secured supplier. Once your product and contract is signed, it is much harder to renegotiate these terms. On the other hand, if your supplier are unable to extend logistical help, find an exporting agent or freight forwarder that can help you navigate the clearance procedures for each type of incoterm.

3. Understand the various regulations, tariffs, and licenses you need to export.
Italy is part of the EU and at this stage Australia and EU does not have a Free Trade Agreement. The process of establishing the FTA is currently in progress (as of Feb 2019) and the successful implementation of one will mean that tariffs will be reduced significantly.

Since July 1, 2009, all companies established outside of the EU are required to have an EORI number if they wish to lodge a customs declaration or an Entry/Exit Summary declaration. An EORI refers to an Economic Operator Registration and Identification, which allows all transit between the EU nations and to/from other nations outside of the EU.

A large majority of Italian imports into Australia are leather goods, as well as other apparel goods. Having a good customs broker that knows the regulations and transporting requirements with leather and other animal-based products will allow you to not only save money by getting it right the first time, but also protect your goods. You may also be required to obtain an import permit with certain categories of imports, such as batteries.

Duty refunds are available also to certain products. To determine whether or not your product is eligible for a duty refund, you will need to know your product's HS Code and do some research on the Department of Foreign Affairs and Trade website. Alternatively, you can also approach a freight forwarder or customs broker and consult with them to see what type of duty refunds and tax exemption programs you are eligible for.

Australia has strict product safety standards. For instance, any products deriving from wood must be fumigated and treated before being released at the border. More often than not this is done at origin as Australian customs will charge you far more. Make sure your product is compliant with Australian safety standards before importing. A list of regulated products is available on Productsafety.gov.au. However, this site does not include electronic product standards and regulations.

4. Arranging transport for your cargo ahead of time.

Do your research into the target market and where they are hanging out in order to effectively market your product.

The Republic of France has a population of almost 65 million people, making it the second most populous nation in the European Union (EU) after Germany. Its top imports are Cars ($35.1B), Crude Petroleum($20.6B), Refined Petroleum ($16.7B), Aircraft Parts ($15.9B) and Petroleum Gas ($15.3B).

1. Product sourcing & validation
Different to China or other South-East Asian manufacturing countries, due to the government’s policy of ‘national champions’, there is a leading French company present in almost all major services and industries. Therefore, your product may be sourced from a large supplier or conglomerate of that industry. It is always important to validate that your product will be well received in the Australian market with proper background market research.

Product validation is always a necessary step before importing any goods into Australia. If you are a new business, make sure your product or business idea is well and truly marketable and sellable in Australia. Do not over-commit to a big order before doing this step.

2. Discuss terms of trading with your supplier
Your terms of trading could determine how much responsibility you may have with your cargo. On the other hand, if your supplier are unable to extend logistical help, find an exporting agent or freight forwarder that can help you navigate the clearance procedures for each type of incoterm.




3. Understand the various regulations, tariffs, and licenses you need to export.
France is part of the EU and at this stage Australia and EU does not have a Free Trade Agreement. The process of establishing the FTA is currently in progress (as of Feb 2019) and the successful implementation of one will mean that tariffs will be reduced significantly.

Since July 1, 2009, all companies established outside of the EU are required to have an EORI number if they wish to lodge a customs declaration or an Entry/Exit Summary declaration. An EORI refers to an Economic Operator Registration and Identification, which allows all transit between the EU nations and to/from other nations outside of the EU.
